Terms and Conditions

The following General Terms and Conditions of Sale concern the offer and sale of products on the website www.lilpapoe.be or www.lilpapoe.com, owned and maintained by Lil' Papoe, Lovelingstraat 23, 2060 Antwerpen, Belgium, VAT no. BE0726650952. Requests for information should be made to info@lilpapoe.be. By placing an order you indicate that you agree with these conditions. Unless otherwise agreed in writing, the general or specific conditions or stipulations of third parties are not acknowledged by Lil 'Papoe. We have the right to change the Terms of Sale at our full discretion. Any changes to the Terms of Sale will only apply to orders placed on or after the date of change. Terms and Conditions were last updated on April 1, 2020.

 

Seller

Lil 'Papoe has its registered office at Lovelingstraat 23 in 2060 Antwerp and is registered (KBO) under number 0726650952. The VAT number is BE 0726 650 952.

Order acceptance

We are only bound by an order after we have received the payment. The information about the products and the pricing, as well as the detailed order information, as they are available on the website, are not disputable.

Lil' Papoe reserves the right not to accept orders without giving reasons. Orders indicating that the buyer intends to resell the goods can be refused.

Right to renounce

In the context of distance selling to consumers that fall within the scope of the Law of April 6, 2010, the consumer has the right to inform the seller that he / she renounces the purchase, without payment of a fine and without stating motive within ten working days from the day following delivery. If the consumer invokes this possibility, he must return the goods in their original condition and packaging at their own risk and expense to Lil 'Papoe, Lovelingstraat 23, 2060 Antwerp, Belgium. After receipt of the package in pristine condition, the amount of the product - as stated on the order overview - will be refunded. If the order in question was paid with a gift voucher, the refund will also be made in the form of a gift voucher.

 

Liability limitation

The photos and texts illustrating and describing the products on this website are not contractual and exist for informational purposes only. Lil' Papoe is not liable for errors or omissions that occur on the photos, texts or other data on this website.

Retention of title

The delivered goods remain our property until full payment of the price, including all costs and charges, interest on late payments and compensation. In the event of non-payment, we reserve the right to take back the goods, by operation of law and at the expense of the buyer.

Reservations

Articles ordered with 'payment by bank transfer' are reserved for a maximum of 7 working days. Once the period has expired and payment has not been completed, we will cancel this order. If the customer still wishes to complete this order, it must be placed again.

Complaints

Complaints can be submitted by e-mail to info@lilpapoe.be and will be dealt with as soon as possible. Disputes regarding the conclusion, validity, interpretation or execution of the sales contract or of the current general terms and conditions are exclusively governed by Belgian law and fall under the exclusive jurisdiction of the Courts of Antwerp. Information about alternative dispute resolution can be found here, but we reserve the right to submit disputes to courts.

Force Majeure

We are not responsible for any delay in performance or failure to perform our commitments due to events beyond our normal control, including production interruptions, supply difficulties or shortages of raw materials, labor, energy, or transportation, or delays in transportation, strikes, lockouts, work stoppages or other collective labor disputes affecting ourselves or our suppliers, even if these events are foreseeable.

Pricing

The product prices on our webshop are stated in Euro and include VAT and - unless expressly agreed otherwise in writing - excluding shipping costs and any other costs. The delivery and shipping costs are borne by the customer, unless otherwise stated. Prices can be changed at any time. For refunds, the prices are used as stated on the order overview.

Privacy Policy

Lil' Papoe adheres to the new legislation that started in May 2018. More information about this Act can be found here . If you place an order with Lil' Papoe, your data (name, first name, postal and email address) will be included in the customer file of Lil' Papoe. The file is processed in a WIX database. Here you will find the privacy policy of WIX. Your data will not be provided to third parties, unless stated otherwise when placing your order.

Lil' Papoe ensures confidentiality of your personal data. Lil' Papoe occasionally uses a mailing list. Each mailing contains instructions on how to remove yourself from this list. Every user of the website can subscribe to the newsletter to stay up to date by email about the ins and outs of Lil' Papoe. You can access your personal data at any time. If you wish to remove this information from the files in our database, you can always let us know.

Payment Options

Website

You can pay for your order immediately online through our website with a credit card, Maestro or Paypal. When completing your order, you can choose which payment option you wish to use. We use the WIXStores platform for this.

 

Bank Transfer

If you prefer not to pay online, you can choose the option 'manual payment' and transfer the total amount of the order manually to our bank account. You will receive the instructions for this when you complete the order. Your order will be processed after receipt of payment. Products ordered via 'manual payment' are reserved for a maximum of 7 days. Once the period has passed and payment has not been completed, we will cancel this order. If the customer still wishes to complete this order, it must be placed again.

Shipping and Delivery

We work with BPost to deliver our products. Products are only delivered in the countries for which the website allows delivery. If a buyer requests the delivery of goods to take place in a manner other than the usual way, we can charge the associated costs to the buyer. If the delivery takes place in parts, we have the right to regard each delivery as a separate transaction and therefore also to send it separately from each other with the necessary shipping costs as a result. We are not liable for loss or damage of items during shipping.

 

Delivery time

Under the rules of distance selling, Lil' Papoe will perform the delivery of products to the extent possible within the time specified in the order confirmation. If this is not possible (because the order is not in stock or is no longer available), or there is a delay for other reasons, or an order cannot or only partially be executed, the consumer will be notified after placing the order and in that case, he/she has the right to cancel the order without costs and notice of default.

 

Packages are only shipped after payment. Within Belgium, a parcel is normally on the road for a maximum of 3 working days. The stated delivery times are not binding and are only given as an indication.

 

Shipping costs

Unless otherwise stated, the price of the goods does not include their transportation. The costs for this are stated separately.

Shipping costs for countries not included in this table can always be requested.

 

Delivery address

Providing a correct delivery address is the responsibility of the buyer. If an order cannot be delivered and as a result returns to us, we will inform the buyer. If the order must be sent again, shipping costs will be charged again.

 

Customs fees

When you order products to be delivered in a country other than Belgium, you are considered an authorized importer and as such you must comply with the laws and regulations applicable in the country in which you receive the goods. You may be subject to import duties or import taxes may be levied on the goods arriving in your country. All additional costs associated with customs clearance are at the expense of the customer.

Lil' Papoe has no control over these costs and does not know their amount. Since customs policies vary from country to country, you should contact your local customs office for more information.

 

Unclaimed orders

When shipments are returned to us with the message 'not picked up at the post office' or similar, the shipping costs will be charged again for the new shipment.

Returns and Exchanges

Returns

In the context of distance selling, the consumer has the right to inform the seller that he/she wishes to exchange or return the product without payment of a fine and provided that a valid statement is given. This can be done within ten working days from the day following delivery. If the consumer invokes this possibility, he must return the goods in the delivered condition, including packaging, at his own risk and cost to Lil' Papoe, Lovelingstraat 23, 2060 Antwerp, Belgium.

Exchange

An incorrectly placed order can be exchanged by informing us by e-mail and returning the goods at their own expense in flawless condition to Lil' Papoe, Lovelingstraat 23, 2060 Antwerp, Belgium. The desired product is shipped after receipt of the goods. For this, shipping costs will be charged again and any price difference will be settled. If the order has been settled with a gift voucher and a price difference has to be settled, any negative balance will be refunded on the basis of a gift voucher. The prices as stated on the order overview are always used.
